Is an e-signature valid in the UAE?

Short answer: yes, for most commercial contracts. The UAE has recognised electronic signatures for many years, and its current law goes further, with different levels of electronic signature and trust services.

The law

The main federal law is Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services, which replaced the earlier Federal Law No. 1 of 2006. It:

• Recognises electronic documents and electronic signatures as having legal effect.
• Allows contracts to be formed electronically, including by automated systems.
• Sets out levels of signature, from a basic electronic signature to qualified electronic signatures backed by licensed trust service providers, which carry the strongest legal weight.

Free zones such as the DIFC and ADGM have their own rules for matters under their jurisdiction.

Documents that may be excluded

The law excludes some matters, or requires special formalities for them. These typically include personal status matters (such as marriage, divorce and wills), documents that must be notarised, and certain dealings in real estate. Always check whether your document is one of them.

Which signature to use

• Everyday commercial contracts (services, NDAs, vendor and sales agreements): a well-evidenced electronic signature is common.
• High-value or regulated documents, or documents for government bodies: consider a qualified electronic signature, such as one through UAE Pass, or traditional signing.

Keep good evidence

As in any country, the question in a dispute is proof: who signed, when, and whether the document changed. Keep an audit trail of each signer and how they were verified, a fingerprint of the document, and the final signed PDF.

Language and governing law

Contracts with UAE government bodies, and many court proceedings, use Arabic. If your contract is in English only, a certified translation may be needed later. State the governing law and courts clearly, especially if a free zone is involved.

How April helps

[April's e-signature](/features/e-signature) works for contracts in the UAE as well as India: private signing links, optional SMS codes, an audit certificate and a SHA-256 fingerprint on every signed PDF.
